Do we have to go to court?

“Do we have to go to court; actually, go before a judge or jury and let them decide your case?” If you’re asking yourself this question, you probably don’t have to put the decisions about your life into the hands of the judge or jury. That’s because unless you are embroiled in a dispute where cooler heads are not going to prevail anytime soon, then the odds that you can settle your dispute out of court are pretty high.

This probably sounds weird given how much trials are played up in the media and court of public opinion. People are so quick to say, “I’m taking you to court,” that it seems like any argument will end with a judge having to make a ruling. But that couldn’t be further from the truth. According to lawyers.com, more than 90% of divorce cases settle before trial, either by one spouse offering a settlement or through mediation. The same goes for personal injury and civil litigation cases.

As you can see, going to court is actually seen as a last resort.

In fact, there’s only a handful of cases that are likely to end up in court. Examples from the family law world include:
